DISCLAIMER - AGREEMENT
General EULA and Copyright Policies
Users of PROGRAM
must accept this disclaimer of warranty:
PROGRAM
is supplied as is. The author disclaims all warranties, expressed or implied,
including, without limitation, the warranties of merchantability and of fitness
for any purpose. The author assumes
no liability for damages, direct or consequential, which may result from the use
of PROGRAM.
PROGRAM is provided at no charge to the user for evaluation.
If you find this program useful and that you are using PROGRAM
and continue to use PROGRAM after
the trial period (usually 30 days), you must make a registration payment of $FEE
to PinderSoft. The $FEE,
registration fee, will license one copy for use on any one computer at any one
time.
Commercial Site-License arrangements may be made by contacting PinderSoft.
You may pass a non-registered copy of PROGRAM along to your friends, associates and relatives for evaluation.
All registered users may download the latest
current version updates of the PROGRAM
and will be eligible for support services for one year.
Example 1. You have version 2.0
of Program. You are eligible for updates 2.1, 2.2 and
so on, all updates and upgrades pertaining to version 2.0. You will
not be eligible for free updates to version 3.0 and better.
Example 2. Registration numbers
lost or misplaced will be replaced within one year of purchase,
otherwise you will be required to purchase another registration
number.
Liability
PinderSoft will not be liable to you for any special, indirect,
consequential, punitive, or incidental damages (including, without limitation,
damages for loss of business profits, business interruption, loss of business
information, or any other pecuniary loss) arising out of the use of or inability
to use this product. Your entire liability and your exclusive remedy shall
be no more than the amount paid for the particular product. Your rights
may vary from state to state.
Breach of Agreement
You agree to indemnify and hold PinderSoft and its successors
harmless from and against any damages or liability of any kind arising from
your use of the products in any form, any breach of the terms and conditions
of this Agreement, or your negligent act, omission or willful misconduct.
If any part of this Agreement is found void and unenforceable, it will not
affect the validity of the balance of the Agreement, which shall remain valid
and enforceable according to its terms. All license rights granted pursuant
to this Agreement shall automatically terminate upon your breach of this Agreement.

our programs, but...
Any commercial organization distributing PROGRAM
for any kind of remuneration must first contact PinderSoft for authorization. This
authorization will be automatically granted to distributors recognized by the (ASP) as adhering to its guidelines for shareware distributors, and such
distributors may begin offering PROGRAM
immediately (However PinderSoft must still be advised so that the
distributor can be kept up-to-date with the latest version of PROGRAM).
